JUNE 8, 2007

On 5/22/07, Sr. Dep. Fennell, assigned to the Sheriff’s Department Rural Crime Investigation Unit, began investigating an incident involving the theft of a registered 12-year-old Quarter Horse Sorrel Gelding, named “Decaf”, from Maricopa County in Arizona.  The owner of the horse, Jim Welsh, contacted Senior Deputy Fennell after it was believed the horse had been transported to California.  Senior Deputy Fennell worked closely with Inv. Austin from the Arizona Dept. of Ag, Dep. Nichols with the Maricopa County Sheriff’s Dept, Special Inv. Suther with the California State Bureau of Livestock Identification, and State Brand Inspector George Factor with the California State Bureau of Livestock Identification.

The investigation revealed James Burl Smith, age 50 from Wickenburg Arizona, had bought the horse from Welsh for $8,000.00 and paid him with a personal check which was then returned due to insufficient funds.  Smith had already left Arizona with the horse.  It was determined Smith and his wife, 50-year-old Dawn Smith from Wickenburg Arizona, were planning to attend a roping event in the Shafter, California area.

On 5/25/07, Kern County Sheriff’s Dept. Sgt. Reed, Sr. Dep. Fennell, and Dep. Romanini located the Smiths in the Shafter area.  James was arrested for two unrelated warrants.  Dawn was cited and released for an unrelated warrant.  The horse was recovered and with the assistance of Vet. Ansolabehere, Det. Weigand and Res. Dep. Bariffi transported the horse to a location where it was returned to Welsh.

Mr. Welsh was very pleased and thankful for the cooperative manner in which personnel from the states of Arizona and California worked closely together to investigate and locate the horse.

Charges against James and Dawn Smith for PC 497 Bringing Stolen Property into The State, Food & Agricultural Code violations for bringing a horse into California without a health certificate and proof of a negative test of equine infectious anemia are pending.  Charges are also pending in Arizona against James Smith for theft and check fraud. Mr. Smith currently has two felony no-bail warrant holds from Nye County Nevada in regard to check related charges.
